These Terms of Use (“Terms”) are an agreement between you and Kin Compass LLC, a New York limited liability company (“Kin Compass,” “we,” “us,” or “our”), about your use of mykincompass.com and the personalized after-loss checklist we sell (the “Service”).
By purchasing, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not buy or use the Service.
Kin Compass LLC sells a one-time educational checklist. A CERTIFIED FINANCIAL PLANNER™ professional authored the general materials. Buying the checklist does not make us your financial advisor, estate attorney, tax preparer, insurance agent, or fiduciary, and it does not create a client relationship.
The checklist is for general educational and organizational purposes only. It is not financial, investment, legal, tax, or insurance advice. It is not a recommendation to take or refrain from any action regarding assets, accounts, benefits, or professionals. Personalization only includes or excludes modules (for example, veteran items, or a state’s resource links). It is not an analysis of your estate, your family, or the person who died.
Laws and benefits change and vary by state, county, religion, and family. Consult a licensed estate attorney in the relevant state, a CPA, and (if needed) an investment adviser about your facts.
For a one-time fee of $27 USD, you receive access to a generator that builds a printable PDF checklist in your browser, customized from the optional answers you give (age band, religious or cultural tradition, housing, relationship, minor children, ZIP code, veteran status, and an optional name for the cover).
After payment, we give you a session link to the generator. That link is valid for 24 hours. Download and save your PDF during that window. We do not currently keep a customer account or a copy of your PDF on our servers. If you lose the file after the link expires, you may need to purchase again unless we restore access as a courtesy.
We grant you a personal, non-exclusive, non-transferable license to use the checklist for your own family’s situation. You may print it and share copies with people helping you (other family, an attorney, a funeral home).
You may not resell, republish, scrape, or commercially redistribute the checklist or our content. All rights in the Service and the underlying materials stay with Kin Compass LLC.
You must be at least 18. The Service is intended for people handling an after-death to-do list in the United States. It is not directed at children.
Payment is processed by Stripe. We do not see or store your full card number. Prices are in US dollars. Except as in Section 6, the fee is due at checkout.
If you paid and cannot reach the generator, or the PDF fails to generate, email support@mykincompass.com. We will restore access or refund you.
Because this is a digital product delivered immediately, completed downloads are generally not refundable. If something went wrong, write to us within 14 days and we will take a fair look.
Do not misuse the Service, attempt to bypass payment, scrape or copy the item bank for a competing product, or use the Service for anything unlawful. We may disable a session that looks fraudulent.
The checklist may link to government sites, courts, the VA, funeral or religious resources, and similar pages. Those are not our services. We do not control them and we do not endorse a particular funeral home, attorney, or product by linking.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the checklist is complete, current, or error-free, or that following it will produce any particular legal, financial, or religious result.
Religious and cultural items are general educational notes. Practice varies widely by community. Confirm time-sensitive rites with the relevant clergy or community before you rely on them.
TO THE FULLEST EXTENT PERMITTED BY LAW, KIN COMPASS LLC AND ITS MEMBERS, OFFICERS, AND THE AUTHOR OF THE MATERIALS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST OPPORTUNITY, ARISING OUT OF THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE CHECKLIST THAT GAVE RISE TO THE CLAIM (TYPICALLY $27).
Some states do not allow certain limitations. In those states, our liability is limited to the maximum extent permitted.
You will defend and indemnify Kin Compass LLC against claims arising from your misuse of the Service, your violation of these Terms, or your redistribution of the checklist.
Our Privacy Policy explains what we collect. Today we do not operate a long-term customer database. Personalization answers are attached to your payment session so the generator can pre-fill, and the PDF is built on your device.
We may update these Terms. The effective date at the top will change. Continued use after an update means you accept the new Terms. Material changes to a paid purchase you already completed will not apply retroactively to that purchase except as required by law.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in New York County, New York, except that we may seek injunctive relief in any court for IP misuse.
If a provision is unenforceable, the rest still applies. These Terms and the Privacy Policy are the entire agreement about the Service. We may assign this agreement in connection with a sale of the business. You may not assign it. Failure to enforce a provision is not a waiver.
